 İADE & İPTAL KOŞULLARI VE GENEL KURALLAR

Yönetmeliğin “Cayma Hakkının Kullanımı ve Tarafların Yükümlülükleri” ni düzenleyen “Üçüncü Bölüm” başlığı altında yazılı maddelerinin, “Yolcu Taşıma Hizmetleri” ne uygulanmaması sebebi ile; ALICI’nın cayma hakkı bulunmamaktadır.

SATICI, ALICI’nın belirtilen tarihlerde ödeme yapmaması durumunda ödemelerdeki gecikmelerde mecbur kalmadığı hallerde gecikme faizi uygulamaz. Ancak ALICI ayrıntılı tur programında aksi belirtilmediği sürece turun hareket tarihinden en geç 15 gün öncesine kadar ödemelerini tamamlamak zorundadır. Aksi takdirde SATICI işbu sözleşmeyi tek taraflı olarak iptal etme hakkını saklı tutar.

SATICI, gerekli tüm özeni göstermiş olmasına rağmen gezinin başlamasına veya devamına engel teşkil eden; gerekli yolcu sayısı kadar kesin kaydın oluşmaması ve/veya olumsuz hava koşulları, yol engeli, grev, terör, sis, savaş ihtimali, öngörülemez teknik hususlar ve tüm mücbir sebeplerden dolayı geziyi iptal veya tehir edebilir. Bu durumda tüketicinin tazminat hakkı yoktur.

Nedeni ne olursa olsun ALICI tarafından yapılacak herhangi bir iptalde ALICI, tur ücretinin bakiyesinin tamamını ödemeyi taahhüt eder ve o ana kadar yapmış olduğu ödeme iade edilmez.

ALICI satın aldığı turu şehir içi günlük turlarda 3 gün öncesine, yurt içi turlarda 20 gün öncesine kadar, yurt dışı turlarda 30 gün öncesine kadar bir başkasına devredebilir. SATICI bu sürenin ALICI lehine uzaması için elinden gelen gayreti göstereceğini taahhüt eder. Devir alan kişi, bakiyeden, devir alınmasıyla doğabilecek masraflardan devir edenle birlikte müteselsilden sorumludur. Devir alan kişinin işbu satış sözleşmesi ve formlarda imzası olmasa bile işbu sözleşme hükümleri ile bağlıdır.

Zamanında vize alınamaması durumunda tur iptal koşulları işbu sözleşme maddelerinde belirtilmiştir. Zamanında başvuru ve konsoloslukların talep ettikleri belgeleri zamanında ve eksiksiz olarak sunmak ALICI’nın sorumluluğu altındadır. Vize alınamamasından ALICI, SATICI’yı hiçbir şekilde sorumlu tutamaz.

Özetle; hiçbir hizmetimizde iptal ya da iade hakkı tanınmamış olup; değişiklik ile hükümler SATICI’nın onayına bağlı kılınmıştır.

Due to the non-application of the provisions under the “Third Section” regulating the “Exercise of the Right of Withdrawal and Obligations of the Parties” of the regulation to “Passenger Transportation Services,” the BUYER does not have the right of withdrawal.

In the event that the BUYER does not make payments on the specified dates, the SELLER does not apply late payment interest in cases where it is not obliged to do so. However, unless otherwise specified in the detailed tour program, the BUYER must complete payments at least 15 days before the departure date of the tour. Otherwise, the SELLER reserves the right to unilaterally cancel this agreement.

SELLER, despite taking all necessary care, may cancel or postpone the trip due to reasons such as the definite registration not being reached for the required number of passengers and/or adverse weather conditions, roadblocks, strikes, terrorism, fog, war probability, unforeseeable technical issues, and all force majeure events. In this case, the consumer has no right to compensation.

Regardless of the reason for any cancellation by the BUYER, the BUYER undertakes to pay the entire balance of the tour fee and the payments made up to that point are non-refundable.

The BUYER can transfer the purchased tour to another person up to 3 days before local daily tours, 20 days before domestic tours, and 30 days before international tours. The SELLER commits to making every effort to extend this period in favor of the BUYER. The transferee is jointly and severally liable with the transferor for any expenses arising from the transfer, regardless of whether the transferee has signed this sales contract and forms.

In the event of failure to obtain a visa on time, the cancellation conditions for the tour are specified in this contract. The timely application and submission of the documents requested by consulates are the responsibility of the BUYER. The BUYER cannot hold the SELLER responsible for the failure to obtain a visa in any way.

In summary, no right of cancellation or return is granted in any of our services, and changes are subject to the approval of the SELLER.
